Terms and Conditions

Welcome to the Rust Bucket Rumble Giveaway (the "Giveaway"), hosted by Affordable Air and Plumbing (the "Host"). By entering this Giveaway, you agree to comply with these terms and conditions. Please read them carefully before participating.

1. Eligibility

  • Contestants must be 18 years of age or older at the time of entry.

  • Contestants and their air conditioners must reside in either Cape Coral, Florida, or Fort Myers, Florida.

  • Employees of Affordable Air and Plumbing and affiliates, as well as their immediate family members, are not eligible to participate.

3. Giveaway Period

  • The Giveaway begins on January 15, 2025 and ends on February 14, 2025.

  • Entries submitted after the deadline may not be considered for the prize.

4. Selection Process and Prize Details

  • The prize consists of one (1) new air conditioner of the same or similar efficiency of the winner's current air conditioner. Installation costs are included.

  • The giveaway prize includes a new furnace. Duct work, if required, is not included and will be the responsibility of the winner.

  • The winning air conditioner must be currently in use and operational at the time of selection.

  • Entries will be grouped by the age of the contestant’s current air conditioners. From the pool of the oldest air conditioners, the Host will select one winner.

  • The winner will be selected and announced within Q1 of 2025. A specific announcement date will be provided closer to the time of selection.

  • The winner will be contacted directly via the email and phone number provided during entry.

  • Total number of winners: one (1).

  • The winner must allow an on-site inspection to verify the age and condition of their current air conditioner.

  • If the winner does not claim their prize within 7 days of first contact, they forfeit the prize and the host may select a new winner.

  • No cash equivalent or substitutions are allowed.

5. Consent and Publicity

  • By entering the Giveaway, contestants agree to allow Affordable Air and Plumbing to take photos, videos, and other media of their home, air conditioner, and the installation process.

  • The Host retains the right to use this media for promotional purposes without additional compensation.

6. Communications and Opt-Out

  • By participating, entrants agree to receive promotional emails from Affordable Air and Plumbing. Participants may opt out of these communications at any time by clicking the opt-out link included in the emails.

7. Additional Terms

  • Affordable Air and Plumbing retains the right to disqualify any entries that do not comply with these terms or are deemed inappropriate.

  • The winner may be required to provide further information, for reporting purposes if the prize value is subject to IRS disclosure.

  • The Host is not responsible for any taxes incurred by the winner as a result of accepting the prize.

8. Liability

  • Affordable Air and Plumbing is not liable for any technical issues, delays, or malfunctions that may affect the entry process or winner selection.

  • The Host is not liable for any damages or injuries resulting from the improper use of the prize.

9. Agreement to Rules

  • By participating, entrants fully and unconditionally agree to these terms and the decisions of the Host, which are final and binding.

10. Dispute Resolution:

  • Any disputes arising from this giveaway will be resolved exclusively by binding arbitration in accordance with the rules of the American Arbitration Association (AAA).

  • Arbitration will take place in the state of Florida, and participants agree that the arbitration decision will be final and binding.
